Please read these Terms of Service carefully before using Mentiond. These Terms govern your access to and use of our platform and services.
By accessing or using Mentiond ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By creating an account or using the Service in any way, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement.
Mentiond is a SaaS platform that monitors brand visibility in AI-generated recommendations, measures AI Shortlist Share, scores content for Generative Engine Optimization (GEO), and provides related analytics and reporting tools.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will not be liable to you or any third party for any such modifications, suspension, or discontinuation.
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to notify us immediately of any unauthorised use of your account. Mentiond is not liable for any loss or damage arising from your failure to maintain the security of your account.
Paid plans are billed monthly or annually in advance. All fees are stated in USD and are non-refundable except as expressly set out in these Terms or required by applicable law.
By providing a payment method, you authorise Mentiond (via our payment processor, Stripe) to charge you for the plan you select. If your payment fails, we may suspend or downgrade your account until payment is received.
We reserve the right to change our pricing at any time. If we increase prices, we will provide at least 30 days' notice by email before any price change takes effect for existing subscribers.
All plans include a 14-day free trial with no credit card required to start. At the end of your trial, you must add a valid payment method to continue using paid features. If you do not provide payment details, your account will be downgraded to the free tier (if available) or access will be suspended.
You may cancel your subscription at any time from the Billing section of your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period for which you have already paid.
Mentiond does not provide refunds for unused portions of a subscription period unless required by applicable law.
You agree not to use the Service to: (a) violate any applicable law or regulation; (b) infringe the intellectual property rights of any third party; (c) attempt to gain unauthorised access to any system or network; (d) transmit malware or other harmful code; (e) engage in any activity that interferes with or disrupts the Service.
We reserve the right to suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that you have violated these Terms.
All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and data — are the exclusive property of Mentiond or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You retain ownership of any data or content you submit to the Service. By submitting content, you grant Mentiond a non-exclusive, worldwide, royalty-free licence to use, process, and display that content solely for the purpose of providing the Service to you.
You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying software without our prior written consent.
To the fullest extent permitted by applicable law, Mentiond and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of the Service.
In no event shall our total liability to you for all claims arising out of or relating to these Terms or the Service exceed the amount you paid to Mentiond in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any AI-generated data or recommendations provided through the Service.
These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New Zealand. If you are a consumer located in a jurisdiction with mandatory consumer protection laws, those laws may also apply.
We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify you by email or by displaying a prominent notice within the Service at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
